This is to certify that a certain notice of encroachment given
by a letter dated September 19, 1977, from the Office of the
City Engineer, City of Carmel, Indiana, to Ronald A. Brown and/
or Carol A. Brown, and recorded in the Office of the Recorder
of Hamilton County, Indiana, under Instrument No. 3348, Book 152,
page 315, affecting the following described real estate located
in Hamilton County, Indiana:
Lot Numbered 7 in Eden Estates, Section One, an addition
in Hamilton County, Indiana, as per plat thereof recorded
in Plat Book 5, page 84 -85 in the Office of the Recorder of
Hamilton County, Indiana,
commonly known as 11764 Eden Estates Drive, Carmel, Indiana
46032, is waived and released to the extent that the structures
(fences) encroaching on the utility easements are hereby per-
mitted, but that owners of the above described real estate,
present and successive, are hereby notified that all reconstruc-
tion costs incurred,in returning those structures or underlieing
sewer to their original condition, in the event of necessary
excavation for utility repair purposes shall be born by said
owner or owners.
