AGREEMENT TO ACCEPT DEDICATION OF SEWER AND WATER MAINS
WHEREAS, residents of Carmeltown Condominiums, Inc., also
known as Carmelaire (Carmeltown) desires that the City of Carmel
by and through its Board of Public Works and Safety (the Board)
accept the water and sewer mains into the City's water and sewer
system and maintain said utilities; and
WHEREAS, the City of Carmel is willing to accept dedication
of the Carmeltown Condominiums, Inc., a /k /a Carmelaire water and
sewer mains subject to certain conditions set forth hereafter;
NOW, THEREFORE, In considerations of the mutual covenants
and conditions set forth below parties agree as follows:
I. Carmeltown Condominiums, Inc., a /k /a Carmelaire hereby
dedicates to the City of Carmel, Indiana, and through
its Board of Public Works and Safety its sewer and
water mains a description of which is attached hereto
as exhibit "A
II. The City of Carmel, by and through its Board of Public
Works and Safety agrees to accept and maintain the
water and sewer mains subject to the following
conditions:
A. That this Agreement, when fully executed will
become a part of the covenants to the Carmeltown
real estate and shall be recorded in the office
of the Hamilton County Recorder.
B. That the City of Carmel, Indiana, shall not be
responsible for damage done to any lot or
property encroaching on the sanitary sewer or
water main which is part of this dedication.
C. That all encroaching lot owners agree in writing
to waive any and all damages or claims against
the City of Carmel as a result of any repair work
now or hereinafter required to the Carmeltown
sewer and water mains.
FURTHER, that the following individual lots and
properties within Carmeltown are known at this
time to encroach on the dedicated sewer and water
mains:

Lot 37 -Sewer Line Under Wood Deck

III. Carmeltown further agrees to dedicate any right -of -way
or easement necessary for the repair and maintenance of
the dedicated sewer and water mains, a copy of which
easements of right -of -ways is attached hereto and made
a part hereof as exhibit "B

Meeting called to order 7:30 PM by President Faris

Secretary's Report Approved as read
Treasurers Report Approved as read
Report from Audit Committee read and approved with the additional
statement added to the report that the Treasurer of the Association
be approved to sign checks in the absence of Mr. Greer, Administrative
Manager. Approved.
The Board wishes to give a special thanks to Mr. and Mrs. Greer for
the excellent set of accounting books and all the other details that
they perform as the Administrative Managers. It is especially
satisfying to know this area of our Association is in good experi-
enced hands.
Article 3, Section 6 and 7 of Code of By Laws of Carmeltown
A ssociation, this Board hearby authorizes the issuance of letters of
agreement between effected Lot Owners and Carmel Board of Safety.
Such letters to be signed b�, Lot Owners and returned to the board for
conveyance to Carmel Boarc of Public Works end Safety along with
the agreement between this Board and the City of Carmel. Approved.
Letter from Homeowner, Donald C. and Verda L. Redman, was read to
those in attendance and is made a part of this report. No action
was taken by the Board.
Maintenance Report was approved as read.
Mr. Greer reported that at this time, ten (10) units are listed for
sale in the Complex. It is of concern that the Real Estate Agents
do not compare Condo prices throughout the Carmel area to evaluate
or appraise our listings. They are using only Carrneltown listings
to arrive at the pricing. We s could not accept the present method
and request complete c:ornparison: The value of our investments
should be $10,000 to $15,000 more than we are getting.
Discussion on whose responsibility it is to repair the outside
faucets, the Association or the Homeowner. Tabled for further study.
