Docket No. 07070058 PP: The Legacy (Residential Phase. 1) The applicant seeks primary plat approval for 126 lots on 83.34 acres. The site is located at the 6600 block of E. 146 St. and is zoned PUD /Planned Unit Development. Filed by Ed Fleming of Stoeppelwerth Assoc. for Platinum Properties, LLC. The applicant seeks primary plat approval for 126 lots on 83.34 acres. This is only 83 acres out of 509 acres. The density in this phase is 1.51 units per acre. The layout of this Residential Phase 1 coordinates and complies with the PUD ordinance Z- 501 -07 for The Legacy. This PUD ordinance can be viewed online at: http: /cocdocs.ci. carrel .in.us weblink/DocView.aspx?id= 229157. The initial rezone for this site came through under Docket No. 06050001 Z. The info packet that went along with that rezone does show photographic examples of the proposed housing in this Suburban Residential Use area of The Legacy. At the Oct. 2 committee meeting, the committee voted 5 -0 to move this item to the full plan commission with a favorable recommendation with the following conditions: 1) The city forester must give final approval of the tree preservation plan by Oct.5, 2) Provide email or written documentation of the median cut and 146` Street access, with at least a right in/right out approval from the county, 3) Pull back the stub road to Cherry Tree Grove and allow the existing trees to remain until that subdivision is built to the west, 4) All construction traffic will be form 146 St and River Rd, and 5) Language regarding the pond shapes. DOCS comments /concerns: 1. The City Forester has approved the landscape plan. He has also approved the tree preservation plan. 2. The Engineering Dept has no issues with this primary plat. 4. Provide the status of the Hamilton County Surveyor's approval of the drainage. 5. The Hamilton County Highway Department update: The Developer went before the Board of Commissioners on 11/14/2007. for approval of access on 146th Street. They received approval for four (4) access points. At the west end of the project, the large lot residential, they will have a right -in /right -out /left -in. The County Highway Dept will be working with them on the design of each entrance and some additional agreements for signalization and requests for access in the future. The Department of Community Services recommends the Plan Commission approve this item after all comments and concerns are addressed.
