Re: Request for Administrative Settlement Project: Pennsylvania Street (103` to 106 Parcel: 6 and 6A Landowner: Schneider Management Corporation Date: March 30, 2008 The City of Carmel made the Uniform Property Acquisition Offer to Schneider management Corporation to acquire a portion of its property for the above project. The offer was made in person in Carmel on March 15, 2007. The amount of the offer was $211,780.00 and was based upon the appraisal performed by Dennis O. Otto. A second appraisal was performed by Joseph Traynor. In his opinion, the value of the property being acquired was $212,114.00. Through a series of negotiations the parties arrived at recommended administrative settlement amount of $243,971.42. See the attached December 11, 2007 letter from E. Davis Coots to Trent Newport and the December 14, 2007 response. Additionally, the final figure contained $5,000.00 for concrete work. In support of the administrative settlement we list the following: First, were the City to proceed to file the condemnation case, it is most probable that the landowner will introduce testimony that the values are in excess of those included in the appraisal. The date of valuation in the condemnation case would likely be over year later than the date of valuation of the appraisals. Thirdly, accepting the administrative settlement would bring a present resolution to the question of the fair market value of the property rather than having that determination made at a later point in the condemnation process. Assuming all other legal review and approvals are approved, it is our recommendation that the City of Carmel approve the terms of the above described administrative settlement.
