THIS INDENTURE WITNESSETH: A P P R O V E D A S T O FORM BY
That Brookview Properties, LLC (Jointly and individually the "Grantor"), the fee simple owner(s) of
the following described real property "Property") described in attached Exhibit A, incorporated herein
by this reference, which Property is located in the City of Carmel, Hamilton County, State of Indiana,
hereby grants, conveys and warrants in fee simple and with no reversionary rights whatsoever retained,
all of Grantor's rights, title, and interest in the Property, to the City of Carmel, Indiana "Grantee
subject to all existing easements and rights -of -way of record, for the sum of One Dollar ($1.00) and
other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged.
This conveyance of real estate is not subject to Indiana gross income tax.
IN WITNESS WHEREOF, Grantor has executed this Instrument on the 3rd day of May, 2004.

ACCEPTANCE OF DEDICATION DEED OF PUBLIC RIGHTS OF WAY
WHEREAS, the foregoing Grantor having filed with the City of Carmel, Indiana "City its
Dedication and Deed of certain real property "Property") to the City for the purpose of establishing
City rights -of -way, which Dedication and Deed is attached hereto and incorporated herein as Exhibit
"A" hereinabove set forth;
AND WHEREAS, the City believes that said fee simple conveyance of property is desirable and
necessary and in the City's best interests;
NOW THEREFORE, the City, by and through its Board of Public Works and Safety, hereby accepts
said Dedication and Deed, and orders that the Instrument of Dedication and Deed described herein be
recorded in the Recorder's Office of the County of Hamilton, State of Indiana, and that said described
real property be, and the same hereby is, declared open and dedicated to the City.

Registered Land Surveyor No. 29800004 on April 13, 2004.
This is an additional South Half, West 116 Street, Right -of -way that lies contiguous and
adjacent to the south line of Fee Simple Parcel 25 as prepared by John M Garvey,
Indiana Registered Land Survey No. S0148 for I.D. O. T Plans for Project No. SIP-
B886(007), dated December 7, 2001 and recorded as Instrument No. 2004 00009485 and
found in the Office of the Recorder of Hamilton County, Indiana
DESCRIPTION
A part of the Northeast Quarter of Section 1, Township 17 North, Range 3 East in Clay
Township of Hamilton County, Indiana being more particularly described as follows:
Commencing at the Northwest corner of the Northeast Quarter of Section 1, Township 17
North, Range 3 East in Clay Township of Hamilton County, Indiana; thence North 89
degrees 28 minutes 02 seconds East along the north line of said quarter section a distance
of 29.70 feet to the Southwest corner of the Southeast Quarter of Section 36, Township
18 North, Range 3 East in Hamilton County, Indiana; thence North 89 degrees 50
minutes 14 seconds East along the north line of said Northeast quarter a distance of
160.30 to the Northwest corner of real estate as contained in Instrument No. 2004-
00009485 and 98- 63360, both found in the Office of the Recorder of Hamilton County,
Indiana; thence continue North 89 degrees 50 minutes 14 seconds East along said north
line 173.00 feet to the northeast corner thereof; thence South 00 degrees 37 minutes 12
seconds West along the east line of said real estate 58.41 feet to the POINT OF
BEGINNING of the following described parcel of land, said point being the southeast
