U STATE OF INDIANA. ;1')/j):!K ss: b COUNTY OF HAMILTON PAGE 85 83 2134 DEDICATION OF SANITARY SEWER AND UTILITY EASEMENT THIS INDENTURE WITNESSETH: That Bauer Commercial Park Family Corp., as owners of all the real estate herein below described, for and in consideration of the sum of One dollar ($1.00) and other good and valuable consideration do hereby grant, convey and quit claim by way of dedication to the City of Carmel, Indiana, for the purposes herein set forth, an easement and right -of -way on, along, in, upon and across the following described real estate for sanitary sewer and utility purposes, to -wit: Strips of ground 15 feet in width by parallel lines to be used as easements for sanitary sewer purposes being 7.5 feet on each side of sanitary sewers in the South half of the Southwest Quarter of Section 8, Township 17 North, Range 4 East, being more particularly located and described. as follows: t Commencing at the Southeast corner of the Southwest Quarter of Section 8, Township 17 North, Range 4 East; thence North 90 degrees 00 minutes 00 seconds West (assumed bearing) on the South line of said Southwest 0 Quarter 640.00 feet to the centerline of an existing sanitary sewer easement recorded in Book 309, page 682 in the office of the Recorder of Hamilton County, Indiana; thence North 00 degrees 10 minutes 48 seconds a West on said centerline parallel with the East line of said Southwest Quarter 902.19 feet to an existing sanitary sewer manhole being the place of beginning of the sewer easement herein described; thence North 74 degrees 47 minutes 10 seconds West on an existing sewer pipe 175.63' feet to a manhole; thence South 89 degrees 42 minutes o 27 seconds West on an existing sewer pipe 400.00 feet C.3 o to a manhole; thence South 86 degrees 38 minutes 10 seconds West on an existing sewer pipe 180.00 feet to a manhole, said manhole being designated as Point E "A" in this easement; thence North 73 degrees 37 minutes v 40 seconds West on an existing sewer pipe 312.00 feet to a manhole; thence North 89 degrees 57 minutes 51 seconds West on an existing sewer pipe 329.40 feet to a manhole, said manhole being designated as Point "B" in this easement; thence North 89 degrees 48 minutes 17 seconds West on an existing sewer pipe 397.30 feet to a manhole; thence South 88 degrees 39 minutes 33 seconds West on an existing sewer pipe 214.30 feet/to a manhole; thence South 00 degrees 09 minutes 23 seconds East on an existing sewer pipe 347.30 feet -to a• manhole; thence South 01 degrees 04 minutes 02 seconds West on an existing sewer pipe 320.00 feet a manhole; thence South 81 degrees 31 minutes 55 seconds West 52.55 feet to the terminus point of this easement on the West line of said Southwest Quarter 345.18 feet North 00 degrees 05 minutes 50 seconds West of the Southwest corner of said Southwest Quarter. Q RP.IaK PAGE 8 6 ALSO: Beginning at the aforesaid manhole designated as Point "A thence South 01 degrees 54 minutes 15 seconds East on an existing sewer pipe 407.00 feet to a manhole; thence South 13 degrees 02 minutes 58 seconds West on an existing sewer pipe and prolongation thereof 153.00 feet to the terminus of this easement 10.00 feet South 13 degrees 02 minutes 58 seconds West of a manhole. ALSO:' Beginning at the aforesaid manhole designated as Point "B thence South 02 degrees 26 minutes 32 seconds West on an existing sewer pipe 343.00 feet to a manhole; thence South 02 degrees 15 minutes 34 seconds East on an existing sewer pipe and prolongation thereof, 382.00 feet to the terminus of this easement 10.00 feet South 02 degrees 15 minutes 34 seconds East of a manhole. Public or private utilities shall have and retain the right to enter upon said utility and sanitary sewer easement and right of way to lay, maintain, repair, make alterations, inspect and replace utility lines or sanitary sewers either above or below ground surface, together with placement of all appurtenances or attachments or incidental equipment thereon across, on and along the above described real property located in Hamilton County, Clay Township, Indiana. The undersigned persons executing this Dedication of Sanitary Sewer and Utility Easement on behalf of the granting corporation represent and certify that they are the duly elected officers of said Corporation and have been fully empowered, by proper resolution of the Board of Directors of said Corporation, to execute and deliver this easement; that the granting corporation has full corporate capacity to convey and dedicate the above and foregoing easement and right of way and that all necessary corporate action for the making of such conveyance has been taken and done.
