ASSIGNMENT OF SEWER AND WATER EASEMENTS
CARMEL CLAY SCHOOLS OF HAMILTON COUNTY, INDIANA, a School
Corporation duly organized and existing under the laws of the
State of Indiana, (the "Assignor for good and sufficient
consideration as described in the terms of an "Agreement to
Construct Off -Site Utility Improvements" dated February 15, 1988
executed by Assignor and the City of Carmel, by and through its
Board of Public Works (the "Assignee does hereby grant, convey
and assign unto the CITY OF CARMEL, INDIANA (the "Assignee all
of its right, title and legal interest in and to the following
described sewer and water easements acquired by Assignor to
construct, operate, control, maintain, reconstruct, change the
size of, repair and remove a pipeline to be use for the
transmission of sewage and /or water along, under, through and
across the real estate described therein, to -wit:
1. Easement dated May 16, 1988, from Stephen M.
Webster and Susan A. Webster and recorded May 19,
1988 as Instrument No. 809302 in the Office of
the Recorder of Hamilton County, Indiana.
2. Easement dated May 6, 1938, from Genieve Noble and
Robert E. White and recorded May 10, 1988 as
Instrument No. 8808657 in the Office of the
Recorder of Hamilton County, Indiana.
3. Easement dated May 9, 1988, from Robert H. Bracken
and Josephine H. Bracken and recorded May 10,
1988 as Instrument No. 8808652 in the Office of
the Recorder of Hamilton County, Indiana.
4. Easement dated May 13, 1988, from O. Scott
McKinney and Luciene M. McKinney and recorded May
19, 1988 as Instrument No. 8809304 in the Office
of the Recorder of Hamilton County, Indiana.
5. Easement dated May 16, 1988, from Lynnwood Farm
Associates, Ltd. and recorded May 17, 1988 as
