WATER AND SEWER LINE EASEMENTS TO

TOWN OF CARMEL, INDIANA
THIS INDENTURE WITNESSETH: That
CARMEL CEMETERY ASSOCIATION, hereinafter called "Grantor for
and in consideration of the sum of One Dollar ($1.00), the receipt of which
is hereby acknowledged, does hereby GRANT, QUITCLAIM AND CONVEY
into the TOWN OF CARMEL, INDIANA, hereinafter called "Grantee and
easement and right of way with the right to lay, maintain, repair, make
alteration to, inspect or replace one (1) water line and one (1) sewer line
for the transmission of sanitary sewage and water for the Town of Carmel,
Indiana, together with necessary appurtenances or attachments thereto
across, on and along the following described real property located in
Hamilton County, Clay Township, Indiana and as more particularly designated
on the map attached hereto, made a part hereof and marked "Exhibit A",
to -wit:
SEWER LINE EASEMENT
Part of the East half of the Southeast Quarter of Section 24,
Township 18, Range 3 East, described as follows:
Thirteen (13) feet by parallel lines along the north side of the
following line: beginning at a point 1,243.27 feet north of the
Southeast corner of the East half of the said Southeast quarter
section, thence west a distance of 281.0 feet to an existing
manhole; Five (5) feet by parallel lines along either side of the
following line: 'northwest on an angle established at 61 degrees
51 minutes a distance of 654.97 to a point which thus intersects
the property line of grantor.
WATER AND SEWER TAP
The Grantor: is hereby entitled to one water tap, one meter setting, and
one sewer tap furnished by the Granter at no charge to the Grantor.
WATER LINE EASEMENT
Part of the East half of the Southeast Quarter of Section 24,
Township 18, Range 3 East, more particularly described as
follows:
Beginning I, 243.27 feet north of the Southeast Corner of the
East half of the Southeast quarter section, thence west 1001.6
feet to a point; thence north and parallel to said north south
section line a distance of 311.7 feet to a point; thence north
58 degrees 15 minutes east a distance of 469.3 feet, thence
following the meanderings of the east line of Highway #31 on
a radius a distance of 218.3 feet to a point; thence east a
distance of 450.61 feet; to a point on the east line of said
Section 24; thence south on and along said section line a di
distance. of 697.28 to the point of beginning, SAID EASEMENT
TO BE ESTABLISHED SPECIFICALLY AS FOLLOWS:
Ten (10) feet along the entire north line of the above described
property with an additional ten (10) feet for TEMPORARY CONSTRUCTION
EASEMENT thereon.
The sewer and water lines referred to herein shall be and remain
buried to a depth from the surface so as not to interfere ,with the normal
use of said property by grantors, including driveways or other access use.
At any time it may become necessary for grantee to excavate to reach said
pipelines, or either of them, grantee or its agents shall back fill and restore
said surface area to the condition equal to that existing prior to such
excavation, including any sod or grass, trees, shrubs or fences which may
be damaged thereby. Grantee agrees to protect grantor, its transferrees

or assigns, and hold grantor harmless from any and all claims for
personal injury or property damage sustained or claimed by any person
in connection with such entry and /or while such person is on grantor's
property.
•This is a permanent easement and shall run with the land. The
persons executing this easement on behalf of grantor certify that they are
duly empowered by property resolution and authority to execute and
deliver this easement and bind the grantor thereto.
IN WITNESS WHEREOF the said CARMEL CEMETERY ASSOCIATION
has caused this easement to be executed and delivered this 9-1
