'Z 4 WATER LINE EASEMENT PAGE 1 REVIEWED BY HAMILTON 9421543 COUNTY AUDITOR'S OFFICE C A 3 day WATER LINE EASEMENT The undersigned, in consideration of the sum of One Dollar (1,1.00) and other consideration, receipt of which is hereby acknowledged, hereby grants unto The City of Carmel Board of Public Works and Safety, its successors and assigns, a right of way and easement to install, construct, operate, maintain, repair, supplement and remove, at any time or times hereafter, its water line as it may frorn time to time require or deem proper thereof, in, under and upon a strip of land located in Southwest. Quorter of Section 25, Township 18 North, Range 3 East, Clay Township, Hamilton County, Indiana, more particularly described as follow: An easement for water line purposes over, under and across o part of the Southwest Quorter of Section 25, Township 18 North, Range 3 East, Clay Township, Hamilton County, Indiana, being a strip of land fifteen (15) feet of even width, more porticularly described as follows: Commencing at the Northwest Corner of the Southwest Quarter of Section 25, Township 18 North, Range 3 East, Clay Township, Hamilton County, Indiana, thence South 00 degrees 08 minutes 50 seconds West 67.00 feet along the West line of said Southwest Quarter to a point on the apparent Southerly Right —of —Way for Old U.S. 31 (Meridian Street) as per located on a survey performed by Weihe Engineers, Inc. dated December 10th of 1992, shown as Job No. 92 -1619; thence South 35 degrees='29 minutes 58 seconds West 221.00 feet along said Right of —Way line to the POINT OF BEGINNING for the herein described easement; thence South 54 degrees 40 minutes 10 seconds East 174.80 feet; thence South 00 degrees 08 minutes 50 seconds West 91.83 feet parallel with the West line of said Southwest. Quarter; thence South 40 degrees 17 minutes 06 seconds East 78.12 feet to a point being on the South Line of the real estate recorded in Deed Record 346, Page 236 -237 as shown on said Weihe Engineers, Inc. survey; thence South 88 degrees 49 minutes 30 seconds West 19.33 feet on said South line; thence North 40 degrees 17 minutes 06 seconds West 71.45 feel to a point being on the West line of said Southwest Quarter; thence North 00 degrees 08 minutes 50 seconds East 89.58 feet along said West line, said point lying South 00 degrees 08 minutes 50 seconds West 174.2 feet frorn the Northwest Corner of the Southwest Corner of soid Section; thence North 54 degrees 40 minutes 10 seconds West 167.07 feet to a point being said apparent Southerly Right —of —Way for Old U.S. 31 (Meridian Street), thence North 35 degrees 29 minutes 57 seconds East 15.00 feet to the POINT OF BEGINNING, containing 5046 Square Feet, more or less. Also the right of ingress and egress over and across said strip and land adjacent to said strip for the purpose of exercising the rights herein granted. The Grantee agrees to be responsible and pay for all damages to the Grantor's property and /or crops that have been caused by the construction and maintenance of said water line. The Grantee agrees to defend, sove, and hold harmless the Grantor from any and all claims for personal injury, including death or property damage, arising out of the construction or maintenance of said water line in the above described easement. The Grantor warrants that no structure or building, except fencing, driveways or streets shall be erected upon said easement. The Grantor agrees to notify the Grantee before any construction of any fences, driveways or streets is started. The Grantor reserves. after the completion of said water line the full use of the land which is not inconsistent with existence and rnaintenance of said line, but does agreement to notify the Grantee of any proposed change in elevation or grade within the area of said easement.
