Gray - Foster, Hazel Sanitary Sewer SANITARY SEWER EASEMENT TO THE TOWN OF,:.C.A.RMEL For and in consideration of the sum of One Thousand Dollars ($1, 000.00) the undersigned, HAZEL FOSTER, of Hamilton County, Indiana, does hereby dedicate, quitclaim and grant unto the TOWN OF CARMEL, INDIANA, as a utility easement, the real estate hereinafter described to be used as herein- after more specifically set forth: Land in Hamilton County, State of Indiana, being part of Southeast quarter, Section 29, Township 18, North, Range 4, East more particularly described as follows: A strip of ground 15.00 feet in width, lying 7.50 feet on each side of following described center line: Commencing at Southwest corner of the aforementioned quarter section; running thence North 89°48 East along the South line thereof a distance of 652.85 feet to the point of beginning of the line described herein; running thence North 05 15`00" West a distance of 407.08 feet; running thence North 24 39'11" West a distance of 397.10 feet; running North 10 35 41" West a distance of 437.79 feet; running thence South 87 37'34" West a distance of 381.73 feet to a point on the owners West line, said point also being the terminus of the line described herein This strip of ground contains 24, 355 square feet. To the above permanent easement there shall be added 7 1/2 feet on either side for temporary construction easement. (1) Said easement is to be used by the Town of Carmel for the installation and maintenance of a sanitary sewer transmission line. No permanent structure shall be erected on said strip, subsequent owners shall take their title subject to the rights of the Town of Carmel for ingress and egress in, on, along and across the above described easement and the Town of Carmel will hold harm- less the owners of said land against any and all claims for injury to person or property resulting from or claimed to have resulted from the presence of any employee or agent of the Town of Carmel while said persons are within said easement and on official business for the Town of Carmel. (2) The Town further agrees to maintain necessary fencing during construction and to protect all live stock maintaining full access to Cool Creek at all times. 1 7 1 1 .'a �GGri y C r (3) The Town further agrees to restore ground surface to its original condition. The Town agrees to make a maximum effort to avoid distrubance to any trees during construction. (4) The granting of this easement is further conditioned that upon the payment of the usual and regular connection and availability charges then outstanding for all other customers of the Town Sanitary Sewer Utility, the owners of the 160 acres now owned by the undersigned, Hazel Foster, and across which this sewer interceptor runs not only will be permitted to connect to said sanitary sewer_ interceptor but, by existing ordinance, will be compelled to connect to said interceptor. This condition shall be binding upon the Trustees of the Town of Carmel, Indiana and their successors in office.
