N5169 -88 Parcel No. 12886 Easement No. The undersigned, in consideration of the sum of One Dollar ($1.00) and other consideration, receipt of which is hereby acknowledged, hereby grants untoIndiana =Bell Telephone Company, Incorporated, its successors and assigns, a right of way and easement to install, construct, operate, maintain, repair, supplement and remove, at any time or times hereafter, its communication systems consisting of conduits, manholes, cables, wire, and fixtures as it may from time to time require or deem proper therefore, in, under and upon a strip of land located in Section 28, Township 18N, Range 4E, Township of Clay, County of Hamilton, State of Indiana, more particularly described as follows: SEE ATTACHED EXHIBIT "A" B "13 Said easement being a part of the real estate owned by the Grantor and described in a Warranty Deed recorded in the Office of the Recorder of Hamilton County, Indiana, in Deed Book 325, page 347. Also the right of ingress and egress over and across said strip and land adjacent to said strip for the purpose of exercising the rights herein granted. The Grantee agrees to be responsible and pay for all damages to the Grantor's property and /or crops that have been caused by the construction and maintenance of said communication system. The Grantee agrees to defend, save, and hold harmless the Grantor from any and all claims for personal injury, including death or property damage, arising out of the construction or maintenance of said telephone system in the above described easement. The Grantor warrants that no structure or building, except fencing, driveways or streets, shall be erected upon said easement. The Grantor agrees to notify the Grantee before any construction of any fences, driveways or streets is started. The Grantor reserves, after the completion of said system the full use of the land which is not inconsistent with the existence and maintenance of said communication system but does agree to notify the Grantee of any proposed change in elevation or grade within the area of said easement. Dear Board Members: Indiana Bell Telephone Company, Incorporated needs to upgrade and expand our facilities in the East 131st Street area of Carmel. Currently we have an underground conduit system which ends near the eastern boundary of Brookshire Lakes Subdivision. We need to extend this system eastward, along the north side of 131st Street, to a point approximately 2100 feet east of Cherry Tree Road. In order to facilitate our construction it is necessary to request an easement across the property owned by the City of Carmel on which Fire Station #4 is located. The easement is needed due to the fact that the public half right of way in front of the fire station is only 16.5 feet which does not allow us to align with the facilities already in place in the 40 foot half right of way in front of Brookshire Lakes. Specifically, we are requesting an easement 30 feet in width lying north of, parallel with and abutting the north right of way line of 131st Street. The easement will begin on the west property line of Station #4 and extend eastwardly to it's east property line, a distance of 180 feet more or less. We plan to place six underground conduits within the easement area. The placement of the conduits will allow us to pull future cables thru the property without the need to disturb the surface areas in any way. Once our construction is completed all disturbed surfaces will be restored to your satisfaction. In particular, we will resurface the asphalt driveway from our trence to the street. I have thoroughly discussed our plans with Fire Chief Steven A. Couts to insure that our construction will not interfere with the operation of the fire station at any time. In fact, we will arrange our construction activities so that the driveway will not be closed to in or out traffic. Steel plates will be used to cover the open trench until restoration is completed. 5e CI ti (2) Attached to this letter is a copy of the easement document and a sketch depicting the requested easement area.
