116th - Marathon Petroleum DRAINAGE EASEMENT S 411
IN CONSIDERATION of the sum of One and No /100 Dollar
($1.00) and other valuable consideration, the receipt of which
is hereby acknowledged, the undersigned hereby grants unto the
City of Carmel, Indiana, a municipal corporation, and its
successors and assigns, Grantee, the perpetual non exclusive
easement and right to construct, operate, patrol, maintain,
repair, replace, reconstruct and remove a storm sewer line, for
the transmission of water along, under or across the following
described real estate situated in the County of Hamilton, and
State of Indiana, to -wit:
Being the East 8.00 feet of the West 253.30 feet of the
South 275.00 feet of the Southwest 1/4 of Section 31,
Township 18 North, Range 4 East of the 2nd Principal
Meridian, County of Hamilton, State of Indiana. Subject
however to easements and rights -of -way of record.
It is the intent of this description to describe an 8.00
ft. wide strip of ground for dainage purposes off the
entire east side of a parcel recorded in Deed Record #210
on Page 145 in the Office of the Recorder for said County
of Hamilton.
The City of Carmel shall have the right to perform
maintenance, repairs and replacement of the storm sewer but
shall not have any obligation to do so.
The Grantor reserves the use of said land not inconsistent
with this grant.
Any damages to any improvements of the undersigned, its
successors and assigns caused by the employees of the Grantee
and occasioned by the original construction or subsequent acts
of the Grantee's employees, shall be promptly repaired or paid
for by the said Grantee upon notice thereof received from
Grantor.
IN WITNESS WHEREOF, the said Marathon Petroleum Company has
caused this instrument to be executed in its corporate name by
its Vice President and Assistant Secretary, and its corporate
seal to be hereto affixed and attested, this 12th day of
October 1990.
