DEDICATION OF SANITARY SEWER AND WATER LINE EASEMENT
The undersigned, Eleanor M. Moffitt, Jacqueline Moffitt, Scott Moffitt and
Cynthia Moffitt (hereafter, jointly, the "Grantor for the good and valuable
consideration, the receipt and sufficiency of which are hereby acknowledged, does hereby
grant and convey to the City of Carmel, Indiana, its successors and assigns, an easement
for the installation and operation of a sanitary sewer line and a water line on, over, across
and through the real estate legally described in Exhibit "A" "Real Estate attached hereto
and by reference made a part hereof, and pictorially described in Exhibit `B" attached
hereto (Sheets 1 and 2) and by reference made a part hereof "Easement
The Easement granted herein includes the right to construct, operate, maintain,
repair, and replace a sanitary sewer line and a water line, and the right of ingress and
egress on and over the Real Estate for any of such purposes.
This Easement is given subject to the right of the Grantor to connect the existing
residence to the sanitary sewer line and water line in the easement.
The Easement shall be an encumbrance of the Real Estate, shall run with the land,
and shall be binding upon each of the undersigned, and their respective heirs, successors,
and assigns.
IN WITNESS WHEREOF, each of the undersigned has executed this Easement
on the day and year hereinafter set forth.

SANITARY SEWER AND WATER LINE EASEMENT
Part of the Northwest Quarter of Section 26 and Northeast Quarter of Section 27, Township
18 North, Range 4 East, Hamilton County, Indiana, centered on and 12.5 feet on each side of
the following described centerline:
Commencing at the Southeast comer of the Northeast Quarter of aforementioned Section 27;
thence North 89° 51' 19" West (assumed bearing) 1098.46 feet along the South line of the
Northeast Quarter of said Section 27 to the East line of the Quail Run at Haverstick
subdivision recorded as instrument number 95 -40437 in the Hamilton County Recorder's
Office; thence North 01° 04' 40" West along said East line 30.22 feet along said East line to
the Point of Beginning of the centerline easement described herein; thence running South 89°
50' 07" East (assumed bearing), parallel with the South line of Section 27 and Section 26,
1553.11 feet, more or less, to the edge of pavement of River Avenue as it exists on October 12,
1995, said point being the point of terminus of the centerline easement described herein.

ACCEPTANCE
WHEREAS, the foregoing Grantor has this day filed with the Carmel Board
of Public Works and Safety, Carmel, Hamilton County, Indiana, its Dedication of
Sanitary Sewer Easement "Dedication which Dedication is hereinabove set forth;
and
WHEREAS, the Carmel Board of Public Works and Safety is of the opinion
that said Dedication is desirable and necessary;
NOW, THEREFORE, the Carmel Board of Public Works and Safety, under
and by virtue of the power conferred upon it by the laws of the State of Indiana,
hereby accepts said Dedication of Sanitary Sewer Easement and orders that this
Dedication be recorded in the Office of the Recorder of Hamilton County, Indiana.
