JCS 6i oo ao "9:4, consideration of the sum of Iii Tl r the receipt of which is hereby acknowledged, do hereby GRANT, QUITCLAIM and CONVEY unto the TOWN OR CARMEL, INDIANA, hereinafter called "Town a water sewer utility easement and right of way to lay, maintain, repair, replace, alter or inspect water sewer utility lines for the transmission and distribution of municipal water sewer utilities, together with the granted right to operate the same on, along, in, upon, or across the following described real estate in Hamilton County, Clay Township, Indiana, To -wit: A strip of ground 5 feet wide lying along the South side of a line 20 feet North of the South line of the Northeast Quarter i of Section 25, Township 18, Range 3 East, and bounded by the East and West property lines of the following described real estate, which is recorded in Hamilton County Recorder Office Book 212, Page 1 47. To -wit: `o Part of the Northeast Quarter of Section 25, Township 18 North, 1 Range 3 East, bounded as follows: a '8 Begin 46 rods 14 feet West of the Southeast corner of said quarter section and run thence North 18 rods 7 feet, West 5 rods, South cad 18 rods 7 feet, East 5 rods to the place of beginning, EXCEPT: E That part of said real estate lying wihin fifteen (15) feet of the center line of the L.N.A. &C. railway heretofore deeded to F. said railway. To the above permanent easement there shall be added 5 feet along and adjoining the North side of the above permanent easement for a temporary construction easement. At any time it should become necessary for grantee to excavate to reach a utility line, the Town or it's agents shall back fill and restore said surface area to the condition equal to that existing prior to such excava- tion. A maximum effort shall be made to avoid damage to any trees or plants within the permanent or temporary easements. The Town shall restore the surface, including but not limited to sod or grass, trees or shrubs which may be damaged thereby to a condition at least equal to that now existing. While the Town or it's agents are on Grantor's property, the Town agrees to protect and hold Grantor harmless for all personal injury claims sustained or claimed to have been sustained bu any person or persons whomsoever in connection with such entry while on the property of the Grantor.
