GRANT OF EASEMENT OVER PRIVATE ROAD
This Grant of Easement Over Private Road "Grant
executed by Lumber Mart, Inc., an Indiana corporation "LMI
WITNESSES THAT:
WHEREAS, LMI owns approximately 125 acres of land
known as "Brookshire Golf Course" in Section 32, Township 18
North, Range 4 East in Hamilton County, Indiana, on which is
located, in the vicinity of the twelfth hole and south of
the property line dividing Lots 277 and 278 in Brookshire
Section Five, a sewage lift station "Lift Station
WHEREAS, LMI has made a commitment to provide the
City of Carmel, Indiana "Carmel with access by motor

vehicle to the Lift Station; This Instrument Recorded

WHEREAS, LMI has constructed an asphalt and gravel
service road on Brookshire Golf Course which leads from the
public thoroughfare known as "Brookshire Parkway" to the Lift
Station, such service road running from the main entrance
to Brookshire Golf Course in a generally southwesterly direc-
tion across Brookshire Golf Course toward the course main-
tenance building and then in a generally easterly direction
toward the twelfth hole to the Lift Station; and
WHEREAS, LMI by this Grant intends to provide Carmel
with such access to the Lift Station and thereby to fulfill
such commitment;

NOW, THEREFORE, in consideration of Carmel's acknow-
ledgment that this Grant fulfills and discharges such commit-
ment, LMI hereby GRANTS to Carmel an EASEMENT on the above
described service road located on Brookshire Gulf Course.
Carmel may exercise the right of easement granted hereunder
to travel on such service road, in common with LMI and its
successors, assigns and invitees, between the Lift Station
and Brookshire Parkway.
IN WITNESS WHEREOF, LMI has executed this Grant this
20th day of April 1976.
