KNOW ALL MEN BY THESE PRESENTS; That the Grantor LANDMARK
DEVELOPMENT COMPANY of Hamilton County, Indiana, in consideration
of the slamoZ One Dollar $1.00 in hand paid, hereby grants
unto the of Carmel, Indiana (Hamilton County) its successors
and assigns, grantee, the right to enter upon and to lay, install,
maintain, repair, replace or renew such sanity sewer together with
the necessary connections attached thereto, upon, along, and under
the following described lands and premises of the Grantor situated
in the southwest quarter of Section 31, Township 18 North, Range
4 East in Hamilton County, Indiana; being more specifically de-
scribed as follows towit:
A strip of ground ten (10) feet in width in a part of the Southwest
Quarter of Section 31, Township 18 North, Range 4 East in Hamilton
County, Indiana, the centerline of said strip being more particularly
described as follows:
Commending at the Southwest corner of the said Southwest Quarter
Section thence North 01 degrees 04 minutes 45 seconds West along
the West line thereof 1752.85 feet; thence North 89 degrees 55
minutes 00 seconds East along the centerline of Carmel Drive 600.00
feet to the POINT OF CURVATURE of a 5.000 degree curve to the left,
the radius point of said curve being North 00 degrees 05 minutes
00 seconds West 1145.92 feet from said point; thence Easterly
along the said curve 400 feet to the POINT OF TANGENCY thereof, the
radius poin'T of said curve being North 20 degrees 05 minutes 00
seconds West 1145.92 feet from said point; thence North 69 degrees
55 minutes 00 seconds East 238.51 feet to the POINT OF CURVATURE
of a 5.000 degree curve to the right,the radius point of said curve
being South 20 degrees 05 minutes 00 seconds East 1145.92 feet
from said point; thence Easterly along the said curve 400 feet to
the POINT OF TANGENCY thereof, the radius point of said curve being
South 00 degrees 05 minutes 00 seconds East 1145.92 feet from said
point; thence North 89 degrees 55 minutes 00 seconds East 127.71
feet; thence North 00 degrees 00 minutes 00 seconds East 40.00 feet
to the POINT OF BEGINNING OF THIS DESCRIPTION (said point being the
North right of way line for Carmel Drive); thence North 00 degrees
00 minutes 00 seconds East 58.00 feet to the END POINT OF THIS
DESCRIPTION.
Said easements subject to conditions' specified in letter of Oct. 3, 1973, from
the Town Engineer, marked Exhibit A.

Dear Aaron,
Enclosed is a copy of a letter from Tom Barnes requesting my opinion
for the best location of his sanitary sewer to serve two tracts of ground
located fronting Carmel Drive in the northeast corner of parcel 10
(as shown on Scherschel's development plan of Keystone Square Complex).
The alternatives open to Mr. Barnes are:
A. 150' of sewer connecting to existing manhole within your
project but not in the public right of way.
AB. 800' of sewer to an existing manhole at the southeast corner of
your project which is in the public right of way.
It would be my desire that the former route be used, (i.e.) The 150'
of sewer connecting to existing manhole within your project.
This would require that you grant an easement to the Town of Carmel across
your ground for this connection.
It should be stipulated that
A. Mr. Barnes "shall construct a manhole on the south side of Carmel Drive.
B. Said construction be completed before the final road work is
done on Carmel Drive and also prior to the tires at which you
have indicated that you intend to construct a decorative wall
across this proposed easement.
C. This connection is to serve only the two tracts of ground
referrenced in this letter belonging to Tom Barnes unless prior
approval be granted by you for additional connections to this
line.
