DECLARATION, GRANT AND AGREEMENT
OF SANITARY SEWER EASEMENT
This Declaration, Grant and Agreement made thisP-o2 day of
,f4/[) 1987, by and between Stratford Center, Ltd., an Indiana
limited partnership "Owner and the City of Carmel "City
WITNESSETH:
WHEREAS, Owner is the Owner of a strip of ground twenty -five (25)
feet in width by parallel lines to be used as an easement for a
sanitary sewer located in the South Half of Section 31, Township 18
North, Range 4 East in Hamilton County, Indiana, said easement to be
centered upon the centerline of an existing sanitary sewer located on
the real estate described in Exhibit "A" attached hereto and by
reference made a part hereof; and
WHEREAS, Owner is willing to create an easement to City, its
successors and assigns, to use the above described strip of ground for
the purpose of maintaining and repairing the sanitary sewer.
NOW, THEREFORE, Owner declares and grants an easement in the above
described strip of ground to City, its successors and assigns, to use
the strip of ground to maintain and repair the sanitary sewer across,
through and under the strip of ground above described. It is
understood that the employees of City, its successors and assigns.,
shall, when necessary, have access to the described easement for the
purposes of maintenance and repairs, provided City, its successors and
assigns, shall be responsible for any damage that may be done to the
above described property of Owner. It is further understood that City
shall return the above described property to its original condition
after performing any maintenance or repairs to the sanitary sewer line.

Legal Description
A Sanitary Sewer Easement in part of the South Half of Section 31,
Township 18 North, Range 4 East, 2nd. Principal Meridian in Hamilton
County, Indiana, being 25.00 feet of even width, 12.50 feet on each
side of the following described centerline:
Commencing at the Southwest Corner of the Southwest Quarter of
Section 31, Township 18 North, Range 4 East, 2nd. Principal
Meridian; thence North 89 degrees 50 minutes 15 seconds East
(assumed bearing) on the South line of said Southwest Quarter
2313.00 feet; thence North 00 degrees 09 minutes 45 seconds West
487.10 feet; thence North 61 degrees 40 minutes 00 seconds West
234.81 feet to an existing sanitary sewer manhole; thence South
27 degrees 45 minutes 54 seconds West 25.84 feet to an existing
manhole; thence South 04 degree 17 minutes 20 seconds West 167.59
feet to an existing manhole; thence South 54 degrees 34 minutes
20 seconds West 52.16 feet to the point of beginning which is the
East line of Stratford Center; thence continuing South 54 degrees
34 minutes 20 seconds West 16.74 feet to an existing manhole; thence
continuing South 54 degrees 34 minutes 20 seconds West 12.50 feet,
the termination of the easement herein described, said termination
point being 12.50 feet Southwesterly of said existing manhole.
The sidelines of this easement are to lengthen or shorten to
terminate at all angle points and said property line.
