PARTIAL RELEASE OF EASEMENT
THIS INDENTURE WITNESSETH, that the City of Carmel
(hereinafter "Grantee by and through its duly authorized
officers, for and in consideration of the sum of One Dollar
($1.00) and other good and valuable consideration, the receipt
and sufficiency of which is hereby acknowledged, does hereby
release and quitclaim unto the owner or owners of record, their
heirs, devisees, grantees, personal representatives, successors
and assigns, all its right, title and interest in and to that
certain portion, and only as to that portion, of the real
estate described in Exhibit A attached hereto and incorporated
herein by reference, which real estate was subject to that
certain Declaration of Easement by and between Dan E. Young and
Shirley J. Young, D S Realty Company and Grantee, recorded in
Book 1, Page 70 in the Office of the Recorder of Hamilton
County, Indiana as Instrument No. 83 -1745.

A strip of ground 10' in width by parallel lines; to be used as an
easement for sanitary sewer purposes; being five feet on each side of a line
which coincides -with the center of an 8° sanitary sewer pipe located in the
East Half of the Southeast Quarter of Section 7, Township 17 North, Range 4
East in Hamilton County, Indiana, being more particularly described as
follows:
Commencing at the Southwest Corner of said East Half of the Southeast
Quarter; thence South 89 57'00 East along the south line of said Southeast
Quarter Section 437.00 feet-to the east line of a tract of real estate owned
by Shell Oil Company; thence North 00 03'00 East along said east line
199.25 feet to a point which lies 15.75 feet south from the northeast corner

as follows:
Beginning on the South line of the Southeast Quarter of Section 7,
Township 17 North, Range 4 East 652.95 feet North 89 57'00" West (assumed
bearing) from the Southeast corner of said Southeast Quarter; thence North
89 °57'00° West on said South line 231.97 feet to a point 437.00 feet South
89 57'00" East from the Southwest corner of the East Half of said Southeast
Quarter; thence North 00 03'00" East 285.00 feet; thence South 89 °57'00"
seconds East parallel with said South line 232.18 feet to a point 652.95
feet North 89 57'00 seconds West from the East line of said Southeast
