THIS INDENTURE WITNESSETH: That Charles S. Weikal and
Jeanette Weikal, husband and wife, of Hamilton County, Indiana, here-
inafter called "Grantors for and in consideration of the sum of One
Dollar ($1.00), the receipt of which is hereby acknowledged, do hereby
GRANT, QUITCLAIM and CONVEY unto the TOWN OF CARMEL, in
Hamilton County, Indiana, hereinafter called "Grantee an easement
and right -of -way and right to lay pipe line or lines to be used for the
transmission of sanitary sewage, together with the right to maintain,
operate, repair, replace and remove the same on, along, in, upon, or
across the following described real estate in Hamilton County, Indiana,

SANITARY SEWER EASEMENT DESCRIPTION.
A part of the Northeast Quarter of Section 31, Township
18 North, Range 4 East in Hamilton County, Indiana, more
particularly described as follows:
Beginning North 90 degrees 00 minutes 00 seconds East
of the Northwest corner of the Northeast Quarter of Section
31, Township 18 North, Range 4 East and on the North line of
the said Quarter Section 158.90 feet; thence South 00 degrees
15 minutes 20 seconds East 16.5 feet to the place of beginn-
ing', thence North 90 degrees 00 minutes 00 seconds East and
parallel to the North line of said Quarter Section 500 feet;
thence South 00 degrees 15 minutes 20 seconds East 10 feet;
thence South 90 degrees 00 minutes 00 seconds West and para-
llel to the North line of said Northeast Quarter 500 feet;
thence North 00 degrees 15 minutes 20 seconds West l0feet
to the place of beginning.
TEMPORARY CONSTRUCTION EASEMENT DESCRIPTION
A part of the.Northeast Quarter of Section 31, Township
18 North, Range 4 East in Hamilton County, Indiana, more
particularly described as follows:
Beginning North 90 degrees 00 minutes 00 seconds East
of the Northwest corner of the Northeast Quarter of Section
31, Township 18. North, Range 4 East and on the North line of
the said Quarter Section 158.90 feet; thence South 00 degrees
15, minutes 20 seconds East 26.5 feet to the place of beginn-
ing;. thence North 90 degrees 00 minutes 00 seconds East
and parallel to the North line of said Quarter Section 500
feet; thence South 00 degrees 15 minutes 20 seconds East 15
feet: thence South 90 degrees 00 minutes 00 seconds West and
parallel to the North line of said Northeast Quarter 500
feet; thence North 00 degrees 15 minutes 20 seconds West

Said pipe line or lines shall be buried to a depth which will not
interfere with the maintenance of lawn by grantors or their assigns
and installationcf same the grantee, or such agent for grantee as
may make such installation, shall back fill and restore said area to
the condition existing prior to excavation. It is further agreed that
if excavation is required in the future for purposes of maintenance,
repair, replacement or removal of pipe, or for any other purpose,
the grantee or its agents will accordingly assure that the area will be
restored to the condition existing prior to excavation. Grantee, or
its agent making such excavation, shall protect the grantors or their
assigns from all claims for bodily injury or personal damage sustained
or claimed by anyone in connection with the installation of said sewer
line or its future .maintenance, repair or replacement.
It is further agreed that this indenture and easement shall run with
the land and shall be :binding upon all future owners thereof.
IN WITNESS WHEREOF, the grantors have hereunto set their hands

and State, personally appeared the above named Charles S. Weikal
and Jeanette Weikal, husband and wife, and acknowledged the
execution and delivery of the foregoing Sanitary Sewage Easement to
the Town of Carmel, Indiana, and further acknowledged the same to
be their voluntary act and deed.
