THIS INDENTURE WITNESSETH: THAT

hereinafter called "Grantor", for and in consideration of the sum
of Ten Dollars ($10.00), the receipt of which is hereby acknowledged,
do ,hereby GRANT, QUITCLAIM and CONVEY unto the City of Carmel, Indiana,
hereinafter called. "City" a drainage easement to construct, maintain
and repair a roadside drainage ditch on, along in, upon, or across
the following described real estate in Hamilton County, Clay Township,
Indiana, to -wit:
A strip of ground 13.5 feet in width by parallel lines lying
north of and adjacent to the north right of way line of 116th
Street, being part of the Southeast Quarter of Section 32,
Township 18 North, Range 4 East in Hamilton County, Indiana, A4-
described as follows:
Beginning on the West line of the Southeast Quarter of Section
32, Township 18 North, Range 4 East on the north right of way
line of 116th Street, 16.5 feet, more or less, north of the
southwest corner of said Southeast Quarter; thence Easterly on
and along said north right of way line 128.5 feet; thence
northerly parallel with the west line of said Southeast Quarter
13.5 feet to a point,30 feet north of the south line of said
Southeast Quarter; thence westerly parallel with said south line
128.5 feet to the west line of said Southeast Quarter; thence
south 13.5 feet to the place of beginning, containing 1735 square
feet, more or less.
Subject to all legal easements and right of way.
While the City or its agents are on Grantors Property, the City agrees
to protect and hold Grantors harmless for all personal injury claims
substained or claimed to have been sustained by any person or persons
whomsoever in connection with such entry while on the property of the
