WHEREAS, the Town of Carmel has heretofore received a permanent
easement for a sanitary sewer from Clyde T. Winkler and Genell J. Winkler,
his wife, of Jefferson County, Alabama, which easement is for the following
described real estate::
An easement 20 feet in width being located in the Southeast
Quarter of Section 36, Township 18 North, Range 3 East,
Hamilton County, Indiana, more particularly described as
follows:
Beginning at a point 450. 9 feet North and 385.2 feet West of
the Southeast corner of said Quarter Section, said point being
on the East line of the Indiana Union Traction Co. R. R. now
abandoned; running thence West 60 feet; thence North along
said West line 673. 32 feet to the North line of the Clyde T.
Winkler property; thence West along the North line of the
Winkler property 20 feet; thence South along the West line
of said R. R. 693. 19 feet; thence East 80 feet; thence North
20 feet to the point of beginning.
and
WHEREAS, the sanitary sewer is to be constructed on a location which
this easement does not describe; and
WHEREAS, Clyde T. Winkler and Genell J. Winkler, his wife, have
executed a new easement for a sanitary sewer to the Town of Carmel,
Hamilton County, Indiana,
THEN BE IT HEREBY RESOLVED, that the Town of Carmel,
by its Board of Trustees, does hereby release the easement
for a sanitary sewer executed by Clyde T. Winkler and Genell
J. Winkler, his wife, to the Town of Carmel, and recorded in
ag-i) Record 230, page 159, in the office of the Recorder
of Hamilton County, Indiana, which permanent easement for
sanitary sewer is over the following described real estate:
