Woodland Springs - Zeigler, Jack/Joyce 0 1 J Q I fil UTILITY LINE EASEMENT TO TOWN OF CARMEL, LTD. THIS INDENTURE WITNESSET:I: That JACK 8. ZEIGLER AND JOYCE A. ZEIGLER, HUSBAND AND WIFE hereinafter called "Grantors for and in consideration of the sum of ONE DOLLAR ($1 .00), the receipt of which is hereby acknowledged, do hereby GRANT, QUITCLAIM AND CONVEY unto the TOWN OF CARMEL, INDIANA, hereinafter called "Grantee an easement and right of way with the right to lay, maintain, repair, make alteration, inspect and replace utility lines for electric transmission and distribution, either above or below ground surface, together with necessary appurtenances or attachments or incidental equipment thereon, across, on and along the following described real property located in Hamilton County, Clay Township, Indiana, to -wit: 6' by parallel lines off the entire west side of Lot 89 in Woodland Springs Subdivision 3d Section as per plat thereof recorded in Book 3, pages 55 and 56 in the office of the Recorder of Hamilton County, Indiana. It is understood and agreed, as a part of the consideration for this easement, i that the Town of Carmel or its agents shall, when necessary, have access to said right of way and lines thereon for purposes of maintaining said lines or equipment and the Town of Carmel shall hold grantors or their assigns harmless from any and all claims for personal injury in connection with or arising out of the presence of such agents while on grantors' property and shall further be re sponsible for all damage to property that may be done to said property.
