ORDINANCE NO. 12 -14 -87
An Ordinance Authorizing and Approving Second
Amendment to the Municipal Waste Water
Service Agreement Between The City of Carmel
and The Clay Township Regional Waste District
WHEREAS, The Clay Township Regional Waste District (the
District) and the City of Carmel (Carmel) entered into an
agreement on the 10th day of June, 1983 under which said agreement
Carmel agreed to accept from the District waste water, liquid
waste and sewage from the District and further agreed to treat and
dispose of the same in a proper manner at its sewer treatment
plant; and
WHEREAS, the District and Carmel have determined that it
would be in their mutual best interests to amend said agreement in
a manner consistent with changes in circumstances involving
planning areas and available capacities at Carmel's sewer
treatment plant; and
WHEREAS, an emergency exists since said amendments have been
approved by Carmel and need to be ratified and adopted by the
District prior to January 1, 1988.
NOW, THEREFORE, BE IT ORDAINED by the Board of Trustees of
the Clay Township Regional Waste District:
Section 1. This ordinance shall be known and may be referred
to as the "Authorizing Ordinance for the Second Amendment to the
Municipal Waste Water Service Agreement between the City of Carmel
and the Clay Township Regional Waste District ".
Section 2. The Second Amendment to the Municipal Waste Water
Service Agreement between the City of Carmel and the Clay
Township Regional Waste District be and the same is hereby
ratified, adopted and approved by the Board of Trustees of the
Clay Township Regional Waste District.
Section 3. The Second Amendment to the Municipal Waste Water
Service Agreement between the City of Carmel and the Clay Township
Regional Waste District is incorporated herein by reference and
made a part hereof as if fully set forth in this ordinance.
Section 4. The President of the Board of Trustees of the
Clay Township Regional Waste District is hereby directed to affix
his signature on the Second Amendment to the Municipal Waste Water
Service Agreement and the Secretary of the Clay Township Regional
Waste District is hereby directed to affix his signature in
attestation thereof.
Section 5. This ordinance shall be in full force and effect
upon the passage hereof. The Secretary of the Clay Township
Regional Waste District is hereby directed to publish this
ordinance in the Clay Township Regional Waste District Ordinance
Book and record the same. This ordinance as well as the Second
Amendment to the Municipal Waste Water Service Agreement shall be
maintained at the District's office.
Section 6. This ordinance, as well as the subject matter
herein is in addition to and shall supersede the ratification
ordinance of the Clay Township Regional Waste District No. 6 -13 -83
only to the extent that the terms of this ordinance are
inconsistent with the terms of such prior ordinance.
Passed by a two - thirds (2/3) majority vote of the Board of
Trustees for the Clay Township Regional Waste District, after the
unanimous consent of the members present to consider this
Ordinance, this 14th day of December, 1987.
