ACCEPTANCE OF DEDICATION& DEED OF PUBLIC RIGHTS-OF-WAY
WHEREAS,the foregoing Grantor having filed with the City of Cannel,Indiana("City"), its Dedication
and Deed of certain real property ("Property") to the City for the purpose of establishing City
rights-of-way, which Dedication and Deed is attached hereto and incorporated herein as Exhibit "A"
hereinabove set forth;
AND WHEREAS, the City believes that said fee simple conveyance of property is desirable and
necessary and in the City's best interests;
NOW THEREFORE,the City,by and through its Board ofPublic Works and Safety,hereby accepts said
Dedication and Deed, and orders that the Instrument of Dedication and Deed described herein be
recorded in the Recorder's Office of the County of Hamilton, State of Indiana, and that said described
real property be, and the same hereby is, declared open and dedicated to the City.

RIGHT OF WAY DEDICATION
Situated in the Township of Clay, County of Hamilton, State of Indiana, and known as being a
part of Southwest Quarter of Section 31, Township I8 North, Range 4 East, also known as being
a portion of a parcel of land conveyed to Fifth Third Bank as recorded in Document No.
2011067185 of said County's Records, and being further bounded and described as follows:
Commencing at a brass pin in a monument box Iound at the southwest corner of said
Southwest Quarter of Section 31, thence along the south line of said Section 31, N 89° 50' 15" h
for a distance of 733.00 feet to a point, thence N 0° 24' 05" L for a distance of 1714.99 feet to a
5/8 inch rebar with cap "MULLANEY LS 21100013" set, said rebar set being on the east line of
a parcel of land conveyed to Cannel Financial Corporation, Inc. as recorded in Deed Book 245,
page 243, said rebar set also being the TRUE PLACE OF BEGINNING for the parcel of land
hereinafter described, thence along the following four (4) courses and distances:
1. Thence continuing along said east line, N 0° 24' 05" E for a distance of 50.66 feet to a point
on the centerline of East Carmel Dr. (80 feet wide), passing over a 5/8 inch rebar with cap
"MULLANEY LS 21100013" set on the existing south right of way line at 10.13 feet;
2. Thence along said centerline along the arc of a curve to the left having the following
properties:
Delta = 9° 10' 05"
Radius = 1145.92
Tangent = 91.88
Chord = 183.16
Chord Bearing=N 76° 22' 35" E for an arc distance of 183.36 feet to a northwest
corner of a parcel of land conveyed to Carmel Racquet Club, Inc. as recorded in Deed Book 312,

3. Thence along a west line of said Cannel Racquet Club, Inc., S I° 18' 23" W for a distance of
52.91 feet to a 5/8 inch rebar with cap "MULLANEY LS 21100013" set, passing over a 5/8 inch
rebar with cap "MULLANEY LS 21100013" found on the existing south right of way line at
42.35 feet;
