CC-03-18-13-03 Bridlebourne Subdivision Interlocal City/Hamilton County Drainage BoardSPONSOR: Councilor Schleif RESOLUTION CC- 03- 18 -13 -03 (FORMERLY CC- O1- 07- 13 -01) A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, APPROVING AND ADOPTING INTERLOCAL AGREEMENT BETWEEN THE HAMILTON COUNTY DRAINAGE BOARD AND THE CITY OF CARMEL REGARDING CONSTRUCTION OF DRAINAGE IMPROVEMENTS WITHIN AND SERVING BRIDLEBOURNE SUBDIVISION WHEREAS, Indiana Code 36-1-7 authorizes cooperative endeavors between governmental entities so as to better and more economically and efficiently serve the public health, safety and welfare; and WHEREAS, Indiana Code 36-1-7-2 authorizes the Common Council to approve such "interlocal agreements ;" and WHEREAS, a certain interlocal cooperation agreement between the City of Carmel, Indiana ( "City ") and the Hamilton County Drainage Board, a copy of which is attached hereto and incorporated herein ( "Interlocal Agreement "), pertains to the construction of drainage improvements within and serving Bridlebourne Subdivison; and WHEREAS, it is in the public interest to approve the Interlocal Agreement. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Carmel, Indiana, that: Section 1. The foregoing Recitals are incorporated herein by this reference. Section 2. The Interlocal Agreement should be and is hereby approved and adopted by the Common Council of the City of Carmel, Indiana. Section 3. This Resolution shall become effective on and after the date and time it is properly approved and signed by a majority of the members of the Carmel Common Council. INTERLOCAL AGREEMENT BETWEEN THE HAMILTON COUNTY DRAINAGE BOARD AND THE CITY OF CARMEL REGARDING THE CONSTRUCTION OF DRAINAGE IMPROVEMENTS WITHIN, AND SERVING BRIDLEBOURNE SUBDIVISION WITNESS THAT: WHEREAS, on May 23, 2011, the Hamilton County Drainage Board, ( "the Drainage Board ") held a public hearing concerning the reconstruction of the portion of the John Osborne Drain serving Bridlebourne Subdivision; and, WHEREAS, since the May 23, 2011 hearing, the Carmel Engineering Department, the Bridlebourne Home Owners Association, the Hamilton County Surveyor's Office, and American Structurepoint have met on numerous occasions to find a solution to flooding in Bridlebourne which did not result in lowering the elevations of the ponds in Bridlebourne; and, WHEREAS, after the meetings set out above, American Structurepoint recommended a drainage plan ( "the Revised Project ") which would improve drainage issues in Bridlebourne by constructing a dry detention pond on a contiguous parcel of land owned by University High School; replacing and/or installing new, larger reinforced concrete drainage pipes connecting the new and existing drainage structures within the Subdivision; and clearing the outlet channel for the Bridlebourne Pond 2; and, WHEREAS, the Drainage Board received a recommendation from the Hamilton County Surveyor on August 7, 2012, concerning the construction of the Revised Project; and, WHEREAS, subsequent to a notice and a public hearing on September 18, 2012, the Drainage Board approved the construction of the Revised Project, by approving the recommendation of the Hamilton County Surveyor, and by issuing its Findings and Order for Reconstruction of the Bridleboume portion of the John Osborne Drain, a copy of which is attached as Exhibit A; and, WHEREAS, the approval of the Revised Project was subject to the approval of an Interlocal Agreement with the City of Carmel concerning payment of the construction costs of the Revised Project; and, WHEREAS, the Carmel City Council and the Drainage Board are desirous of improving the drainage issues within the Bridlebourne Subdivision which were which were identified by both the Hamilton County Surveyor's Office and the Carmel Engineering Department in 2005 and 2011. IT IS THEREBY AGREED by and between the parties as follows: Section 1. The Drainage Board shall prepare final plans, receive bids, and manage the construction for the Revised Project as described in the attached Exhibit B. Section 2. The City of Carmel agrees to pay the costs of the construction of the Revised Project which are estimated at Three Hundred Eighty -two Thousand One Hundred Sixty -nine Dollars ($382,169), as included in the Report of American Structurepoint, which is attached as Exhibit B. Section 3. The City will pay the invoices for the Revised Project which will be approved by the Hamilton County Surveyor and the Carmel City Engineer. Section 4. The City shall pay the costs of obtaining all remaining easements necessary to construct the Revised Project. Section 5. The parties acknowledge that the Project will be partially constructed within the previously existing and dedicated easements within the platted sections of Bridlebourne as shown on the Report. Section 6. The Drainage Board shall continue to collect maintenance assessments within the watershed served by the John Osborne Drain, which includes the Revised Project, and shall continue to perform maintenance of the regulated portions of the Drain. Section 7. In the event any disputes arise concerning the issues in this Interlocal Agreement, those issues shall be informally discussed by the Cannel City Engineer; the Mayor of Carmel or his designee; the Hamilton County Surveyor; and a designated member of the Drainage Board. Section 8. In the event the City and the Drainage Board have disputes which are not resolved by the representatives listed in Section 7 above, the parties agree to submit the dispute to mediation under the Indiana Rules of Alternative Dispute Resolution prior to the initiation of litigation. The dispute procedures listed in Section 7 above, shall not be construed as a final administrative procedure or remedy under the Law. Section 7 above is merely an avenue for the Drainage Board and City of Carmel to attempt to resolve any dispute prior to formal mediation under the Indiana Rules of Alternative Dispute Resolution. Section 9. This Agreement shall be construed as an Interlocal Agreement under the terms of Indiana Code 36 -1 -7 and shall be effective upon approval of the Drainage Board, the Hamilton County Council, and the Carmel Common Council. The Surveyor presented his report to the Board for approval. `August 7, 2012 To: Hamilton County Drainage Board Re: John Osborne Drain, Bridlebourne Reconstruction - Revised This report is a revision of the John Osborne Drain, Bridlebourne Reconstruction report to the Board dated April 11, 2011 and approved at a hearing on May 23, 2011 (see Hamilton County Drainage Board Minutes Book 13, pages 404 to 414). Since that time there have been several meetings with the Bridlebourne Homeowners Association, City of Carmel and my office. This revision is based on the final agreed fixed between the City of Carmel and the Bridlebourne HOA. Attached are plans, specifications and drain map for the reconstruction of the Bridlebourne Drain. This drain is located in Clay Township, more specific on the east side of Shelborne Road between 106c4 and 116`° Streets. The Bridlebourne Drain was established as an arm to the John Osborne Drain by the Board through a petition by the developer. My report to the Board for sections 2 and 3 dated January 7, 1988 was approved by the Board at hearing on February 8, 1988 (see Hamilton County Drainage Board Minutes Book 2, pages 254 - 255). The portion across Section 5 was included in my report dated February 21, 1989 for Larkspur Drain, Sectionl which was approved by the Board at hearing on April 24, 1989 (see Hamilton County Drainage Board Minutes Book 2, page 357). The remainder of the drain is covered in my report for the John Osborne Drain dated December 22, 1994 which was approved by the Board at hearing on February 27, 1995 (see Hamilton County Drainage Board Minutes Book 4, pages 72 -75). Over the period of time that Larkspur and Bridlebourne have been completed, this office has had many complaints regarding high water. Because of the complaints the Board contracted American Consulting, Inc. (now American Structurepoint, Inc.) at the meeting on August 23, 2004 through a RFP process (see Hamilton County Drainage Board Minutes Book 7, page 549). Three options were submitted to this office for review on April 18, 2005. After years of working with the Bridlebourne HOA and additional investigation, it was determine the lakes could not be lowered without causing problems. In mid -2011, Mike McBride, City of Carmel Engineer, and I worked with American Structurepoint to determine a plan to add additional storage volume without being able to lower the normal pool elevations in Bridlebourne. Several options were reviewed during this process. The result of that new engineering was to add a new off -site dry detention basin on the University High School property, which increase the storage capacity available for Pond 1. The dry detention basin will be connected to Pond 1 by a 36" pipe that will be sloped from the dry basin to Pond land has been sized to allow Pond 1 to back up through this pipe into the dry basin. As the level of Pond 1 recedes after the storm events, this runoff stored in the dry basin will be released back into Pond 1 and drain through the existing system. The dry basin was sized to accommodate runoff from storms up to the 10 -year storm event. Larger storm events will utilize the spillway provided on the eastern end of the dry detention basin to overflow into the existing University High School dry basin. The existing University High School pond system was analyzed to verify that there would not be an increase in the runoff rate to the east towa5rs the Spring Mill Run Legal Drain from what was designed release rate of this existing basin. The analysis shows that no detrimental impact will occur to the University High School pond or storm sewer system. EXHIBIT A, P.1 Along with the additional dry basin, some work is proposed to the storm sewer system in Bridlebourne, which is part of the John Osborne Regulated Drain, to remove restriction and improve flow. This work is all shown in the revised final plans that were filed in my office on July 31, 2012. These plans call for the following improvements: 1. The existing 24" RCP between the north inlet on Hintocks Circle and the Larkspur pond to be removed and replaced with a 30" RCP. 2. Expand the storage volume of the Bridlebourne north pond (Pond 1) by creating a separate basin located adjacent to the existing dry basin on the University High School property. The dry detention basin will be connected to Pond 1 by a 36" RCP. 3. The current 18" RCP outlet pipe for the Bridlebourne south pond (Pond 2) to be removed and replaced with an 18" RCP pipe. 4. The current outlet channel between the Bridlebourne south pond (Pond 2) and Sedgemoor Circle Road will be cleared of large woody vegetation and regraded as needed. The reconstructed drain will consist of the following: 18" RCP 140 feet 36" RCP 586 feet 30" RCP 151 feet The total length of new tile shall be 877 feet. Of that footage, 288 feet is replacing existing regulated drain tile or open ditch. This proposal will add an additional 589 feet to the drains total length. The above improvements are outlined in the report submitted by American Structurepoint dated July 29, 2012 and the accompanying plans dated July 30, 2012. Prior to this time Carmel passed Ordinance C -263 which annexed Southwest Clay on November 24, 2004. This was remonstrated against in Hamilton County Superior Court, Cause No. 29003 - 0502 -MI -188. After the filing negotiations between the residents of Southwest Clay and the City of Carmel produced a settlement agreement dated September 6, 2005. This agreement is attached as Exhibit B to the annexation ordinance, Ordinance No. C -263 -A which was passed on October 7, 2005, Instrument No. 200500011849. In this agreement the drainage problems associated with Bridlebourne and Larkspur are set out as items to be addressed with the annexation. The project is mentioned in the Southwest Clay Township Annexation Master Drainage Plan dated July 20, 2009. This plan was prepared for the City of Carmel by Cross Roads Engineers, Inc. In that plan the proposed project for Bridlebourne / Larkspur is considered a first level priority. On February 8, 2011 the City of Carmel passed a bond issue with the Bridlebourne / Larkspur project, Interlocal Agreement C- 266 -11, Instrument No. 2011012198, which included in the funding package. On November 8, 2010 the Hamilton County Drainage Board approved an Interlocal Agreement for the construction by the Drainage Board of the improvements with the funding for the improvements to come from Carmel. On February 7, 2011 this agreement was approved by the City of Carmel. Therefore, the funding of the proposed reconstruction project will be provided by the City of Carmel. Property Owners within the drainage shed will not be assessed for the reconstruction. The current maintenance assessments will not change with this proposal. Other than the purchase of easements mentioned above, no damages will result to property owners by the work; therefore, all damages other than required easements shall be set at s0.00. No state or federal permits are required for this reconstruction. I recommend that this item be set for hearing for September 26, 2012. Sincerely, Kenton C. Ward, CFM Hamilton County Surveyor KCW /llm^ Altman asked if we are currently under an interlocal agreement? Howard stated, no. We're going to ask that if the Board does approve the reconstruction it would be subject to an interlocal agreement. There is an interlocal agreement in place, but it is extremely generic and it doesn't address the issues of use of easements and other things. I'm starting to mark up a previous draft of an interlocal agreement so that both of these will conform and we would not move forward unless or until there was an interlocal agreement to pay the cost and support the project. EXHIBIT A, P.3 The Surveyor stated also to finish the purchase of easements. Howard stated that there are still easements out there to be purchased. Essentially I think there are some new easements, but there are also platted easements that need to be expanded and they're purchasing those. Altman asked if this was purported to be paid from the Carmel Annexation Bond issue? Howard stated, yes. Schrage stated that the project involves a portion of the outlet pipe from Larkspur Subdivision. After the last public hearing we asked this to be continued and we had numerous meetings with the Surveyor's Office, the City of Carmel and the Homeowners Association and now the University High School owners as well to come up with this new solution. There is an existing dry detention basin on the University High School property which drains to the west. The new solution involves constructing an additional dry detention basin adjacent to the existing dry detention basin that would be connected to the Bridlebourne north pond through a 36' pipe. As the north pond elevation rose it would flow back into the existing basin to provide additional storage to reduce the flooding in the north pond of Bridlebourne. As the north pond drained the existing basin would drain through the south pond and back through the Bridlebourne Subdivision. It functions that way through the 10 -year storm event and in some of the larger storm events the existing basin has an overflow to the east to the University High School basin which would then convey the water to the east. The other improvements proposed with this are upgrading the Larkspur pond. There is an existing 30" pipe across the road into Pond No. 1, but in this area the pipe is only a 24' so that pipe would be upsized to a 30' pipe to provide additional conveyance and at the downstream end at Pond No. 2 the outlet pipe is currently inverted and we would replace that pipe to provide additional flow out of Pond No. 2. This started from the September floods in 2003. We performed the modeling; the existing elevation for the north pond stays 899.63 and 896.45 in the southern pond. The proposed elevations would bring those numbers down to 899.01 and 896.43. The north pond saw most of the flooding issues in September of 2003 based on the topography that we picked up. The area flooded and got very close to some of the houses even getting into some of these houses basements. Existing, up to the 100 -year storm would be this yellow line around the pond and with our proposed improvements it would get down back into the banks of the pond. The total cost for this project is approximately 5680,000.00; construction costs are about $400,000.00 of that; land costs for the easements that are required for this project are about 5210,000.00; engineering, surveying and land acquisition services are about 570,000.00. Altman asked how many acres was the new dry detention basin? Schrage stated that the new dry detention basin is approximately three acres. Altman asked if Structurepoint had looked at comps on that? Is this an easement across that land or an acquisition? Schrage stated that there is an easement across the land. Altman asked if this would be constructed so it could be used as athletic fields? Schrage stated that he did not believe so. Altman asked why wouldn't you do that? Schrage stated that the bottom of the dry detention area is flat enough to be used for that, but the sides would be steep. Altman stated that if you could in dry detention, it's not going to be wet that often, why wouldn't you try to redesign it so it could be useful? We're building it and 1 don't want to be complained at because we didn't think ahead and that's fairly simple. Howard stated that the northwest corner of Cumberland Road and Field Drive in Noblesville, practice soccer field; dry detention. Altman stated that sitting at the University property it makes sense. Schrage stated that we could talk to them and look at that. Holt asked if Carmel was involved in the design? Schrage stated, yes they were. Holt asked what Schrage's sense was of what they think of the design? Schrage stated that Carmel is on board with this current design. Holt stated that Carmel has said we think you've got it right'? EXHIBIT A, P.4 Schrage stated that back and forth between the City of Carmel, Homeowners Association and the University High School is how we came up with this solution. Duncan stated that Carmel is on board with this project. The Surveyor's Office and our department have worked through this since the change was proposed. This stems from conversations with the Homeowners Association. I believe we have full support from the Homeowners Association. When it was proposed to move the storage area offsite, outside of the subdivision we approached the University High School and they appeared to be on board with the plan as well. I believe we have concurrence from all affected parties that this is the plan that we'd like to see. Holt asked if the University High School said anything to Carmel on Commissioner Altman's suggestion? Duncan stated that we haven't considered that, but we can look at it. I think we were so focused on the solution that we really didn't think of what could be used there. As a school campus they have a lot of space now so it may not have occurred to them to make that a request. Altman stated even Dad's Club. I see a lot of sharing. All you would have to do is stair step down on the corners to have access. Duncan stated that he believes that they will look at that; I don't see why we couldn't. It's a good suggestion. Dillinger opened the public hearing. Claymon stated that he wanted to go on record that the Homeowners Association is in support of this project. The County, City and everyone involved has done a lot of work to help make this right and help make the solution right. We're relying on engineers that it is right, but from our perspective we appreciate the work that has gone into this and think this is the right solution. With the question about the athletic fields, that's a good point. It has nothing to do with us, but there is that detention basin that is directly to the east of where this one will be so they will probably need to recognize dealing with both of them. Altman stated that one thought she had was if we're buying the easement anyway who will maintain that area? Will it be the responsibility of the City of Carmel or who maintains this thing? Duncan stated that they have had discussions about it, but my expectations are because it's a storm water detention facility, either the City or the County will maintain it. Is it going to be part of the regulated drain system? The Surveyor stated that the facility will be part of the drain, but what we would do is that it would be up to the University High School to maintain it and we need to make sure that in the negotiations for that easement that they realize that. Altman stated that if we have that discussion going on, where maintenance comes back to us, I would think we would have the right to use it for whatever purpose we wanted to; not inconsistent with drainage. Storm System Modifications for Bridlebourne Subdivision Project Description The subject site is located in Hamilton County, Indiana near the northeast corner of 106th Street and Shelbourne Road. The site is bound on the north by the Larkspur Subdivision and the University High School, on the south by the Walnut Creek Woods Subdivision, on the east by the Kingsmill Subdivision and on the west by the Weston Ridge Subdivision. Previous Studies The extreme rainfall event that occurred September 1, 2003 caused unwanted flooding conditions in portions of the Bridlebourne Subdivision and downstream locations. A comprehensive examination of the existing stormwater management system including detention ponds, conveyance structures, and overflow pathways was conducted that identified potential modifications that could lessen the flooding conditions in the future under other extreme storm events. Two previous studies were presented to the Drainage Board. The first study was dated January 7, 2005 and has been included in Appendix C of this report. This study modeled the extreme conditions of the September 1, 2003 storm as well the 100 -year storm events to determine which drainage improvements could increase the capacity and function of this drainage system. The following improvements were recommended by the study: Upsize the outlet pipe from the Larkspur pond from a 24" to a 30" pipe Lower the outlet and increase the outlet pipe size of the Lake 1 outlet structure to increase the detention capacity Lower the outlet and decrease the outlet pipe size of Lake 2 to increase the detention capacity An additional study was then performed and dated February 22, 2007. This study generated additional options to further reduce the flooding concern within the Bridlebourne and surrounding subdivisions. These improvements were as follows: Sections of 24" diameter storm pipe between the Larkspur Pond and Pond l will be replaced with 30" diameter RCP. The normal pool elevation for Pond 1 will be lowered to 1.3' below the current normal pool elevation. The 12" diameter storm pipe immediate downstream of Pond 1 will be replaced with 24" diameter RCP. The normal pool elevation of Pond 2 will be lowered to 1.0' below the current normal pool elevation. The Pond 2 outfall pipe will be replaced with an 18" diameter PVC pipe. The channel between Pond 2 and the Sedgemoor Circle road will be cleared of large woody vegetation and re- graded as needed. A copy of these recommendations can be found in Appendix D. 201100507 EXHIBIT B, P.1 AMERICAN STRUCTUREPOINT, INC. Engineering Approach The rainfall information incorporated into the existing model for the 100 -year 0.5 -, 1 -. 2 -, 3 -, 6 -, 12 -, and 24 -hour storms are that which is typically used and accepted in Hamilton County. As recommended the HERPICC Drainage Handbook, model simulations used the Huff 1 distribution for the 0.5, 1 -, 2 -, 3 -, and 6 -hour storm events, Huff 2 for the 12 -hour storm, and Huff3 for the 24 -hour storm event. Results of the modeling for each storm event were examined and the critical storm frequency and duration was identified the produced the highest stage and greatest outflow. The critical storm identified in this study was the 100 -year, 24 -hour duration storm event. Model input and output data used can be found in Appendix B. Proposed Recommendations After numerous discussions and site visits with Bridlebourne residents, the City Engineer for Carmel, and the Surveyor's office, it became evident that lowering the normal pool elevations of Pond I and Pond 2 was not a feasible option. Additional survey information which was obtained showed the pond depths varied from 5' to 8' in the deepest areas of the pond. Lowering the normal pool elevations could create issues around the perimeter of the pond including erosion problems and additional algae growth due to the shallower depths. Due to the normal pools no longer being lowered, additional options were examined to maintain the result generated by the previous modeling. Options investigated include: Remove the existing islands located within Pond 1 to generate additional volume Increase the overflow elevation from Pond 2 to allow additional storage capacity Expand Ponds 1 and 2 by 10' around the perimeter of each pond Expand Pond 1 onto 2 existing undeveloped lots within the subdivision Expand the existing dry detention basin located on the University High School property and direct runoff from Pond 1 into this basin Provide a separate basin located adjacent to the existing dry basin on the University High School property After analyzing each of these options and the associated costs, it was determined that the following revised recommendations could be constructed to help alleviated flooding concerns: - Upsize portions of the outlet pipe from the Larkspur Pond to Pond 1 from a 24" to a 30" RCP - Replace the existing inverted 18" outlet pipe from Pond 2 with an 18" PVC outlet pipe with a positive slope - Add an additional dry detention basin next to the existing University High School dry detention basin By adding a separate dry detention basin on the University High School property, additional stormwater capacity was able to be provided for Pond 1. The dry detention basin will be connected to Pond 1 by a 36" RCP. This pipe will be sloped from the dry basin to Pond 1 and has been sized to allow Pond 1 to back up through this pipe into the dry basin. As the level of Pond 1 recedes after the storm events, this runoff stored in the dry basin will be released back into Pond 1. The dry basin was 2 EXHIBIT B, P.2 201100507 0 AMERICAN STRUCTUREPOINT, INC. sized to accommodate runoff from storms up to the 10 -year storm event. Larger storm events will utilize the spillway provided on the eastern end of the dry detention basin to overflow into the existing University High School dry basin. The existing University High School pond system was analyzed to verify that there would not be an increase in the runoff rate to the east towards the Spring Mill Run Legal Drain from what was the designed release rate of this existing basin. While this solution does increase the 100 -year elevation of existing basin, the critical storm event will still be maintained below the top of bank and the rim elevations of the castings of the on -site storm sewer system.
